How it works

You don't have to accept contracts from builders as-is. It should be a dialogue. You have the right to request changes—and with strength in numbers and the guidance of our community, you can add features and clauses that reduce your risks.

  • Checkpoints: Before payments are drawn down and released from escrow, you can add checkpoints to the timeline of your project so that you can assess the quality and pace of work before proceeding. You can even tap the insights of your neighbors and trusted community members (peers) to help you assess.
  • Peer-reviewed quality assurance means allowing neighbors and trusted community members to inspect a contractor's work for quality and completion.
  • Group mediation & arbitration: Similar to peer-reviewed QA, in the event of disagreements or disputes with a builder regarding quality or completion of itemized work, group arbitration clauses allow a designated panel of community members to arbitrate disputes between you and your contractor. This is a powerful tool that can help avoid costly litigation, delays, and set expectations of quality at the outset.

Dispute Resolution

Any disputes or disagreements arising from or in connection with this Agreement shall be resolved via Arbitration by , subject to the laws of the State of California.

Governing Law

This Agreement shall be governed by the laws of the State of California.

Entire Agreement

This Contract Addendum and the Original Agreement collectively represent the entire understanding between the Parties and supersede all prior discussions, agreements, or understandings.

Severability

If any part of this Agreement is deemed invalid or unenforceable, that part will be severed, and the remaining provisions will continue in effect.

Notification

All notifications relating to this Agreement should be delivered by either email or post, as agreed upon by the Parties.

Amendment Procedure

Any future changes to this Agreement or the addendum must be in writing and signed by both Parties.

Assignment

Neither party may assign their obligations or rights under this Agreement to a third party without the written consent of the other party.

Waiver

Failure to enforce any provision of this Agreement will not be considered a waiver of that provision or any other provision.

Termination

This Agreement may be terminated under conditions as specified in the Original Agreement or by mutual written consent.

Force Majeure

Neither Party shall be held responsible for failure to fulfill their obligations due to unforeseen circumstances beyond their control.

Conflict Clause

In the event of a conflict between this Addendum and the Original Agreement, the terms of this Addendum shall prevail.

Legal Advice

Each Party acknowledges that they had the opportunity to seek independent legal advice prior to signing this Addendum.
